Mr.Binod Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 06-12-2021 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 302 and other ancillary sections of the Indian Penal Code. As per FIR, this petitioner along with co-accused Arjun Singh caught hold of the hands of informant's father and coaccused Ramendra Singh caused injury with spear at the chest of the deceased which caused death.
Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation of commission of assault against all the accused persons and no specific overt act has been alleged against the petitioner. There is no allegation of causing assault or any injury against this petitioner. Petitioner
Patna High Court CR. MISC. No.51389 of 2021(3) dt.06-12-2021 2/2 is not assailant of the deceased. Co-accused Arjun Singh having similar allegation has already been allowed bail by a coordinate bench of this Court vide para 17. Petitioner is in custody since 21.6.2021 having clean antecedent. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate I, Bhojpur at Ara in Shahpur Police Station Case No. 208 of 2018.
