JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-08-2017 The petitioner seeks regular bail in connection with Sahar P.S.Case no.48 of 2017 registered for offences punishable under Sections 30(a)/38 of the Bihar Prohibition and Excise Act, 2016.

Allegation against the petitioner is about recovery of 225 ltrs. of foreign liquor from his Hotel.

Submission of the learned counsel for the petitioner is that at the time of raid, he was in custody and as such nothing has been recovered in his presence and he is in custody for about one month.

Heard learned A.P.P. also, who has opposed the prayer for bail stating that the hotel belongs to the petitioner. Having heard both sides and in view of the facts and circumstances, as stated above, this application is disposed of with

Patna High Court Cr.Misc. No.40033 of 2017 (2) dt.23-08-2017 2/2 direction to the learned court below to release the petitioner on bail after framing of charge or after completion of three months period in custody, whichever is earlier, in connection with Sahar P.S.Case no.48 of 2017 to the satisfaction of Additional District Judge- IVth, Bhojpur at Ara.
