The petitioner, who is in custody, seeks bail in connection with Masaurhi P.S. Case No. 54 of 2018 registered for the offence punishable under Sections 302, 201, 120(B)/34 of the Indian Penal Code.

Informant is the police official, who in his written complaint has stated that on 27.01.2018 while he was on patrolling duty, he received a confidential information of a dead body of unknown lady lying at Pitmos Road, Nakati Pul at Ghani Chak. After receiving such information he proceeded and found that dead body was lying in the field of Abhimany Kumar and

It has been submitted on behalf of the petitioner that petitioner is not named in the FIR. It has been further submitted that there is no eye witness against the petitioner and the Gamachha is recovered from the open field. It has been further submitted that similarly placed co-accused persons, namely, Rajesh Kumar and Narain Mistry have been granted bail by this Hon'ble Court vide order dated 26.06.2018 and 12.07.2018 passed in Cr. Misc. No. 34082 of 2018 and Cr. Misc. No. 41194 of 2018. Petitioner is in custody since 07.02.2018. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Session Judge-IV, Patna, in connection with Masaurhi P.S. Case No. 54 of 2018.
