JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-08-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered under Sections 272, 273, 120-B of the Indian Penal Code and Section 30(a), 38(2), 41(1)(2)/47 of the Bihar Prohibition and Excise Act, 2016.
As per allegation, 1762 of country made liquor was recovered from the accused persons who have disclosed the name of the petitioner.
Submission of the learned counsel for the petitioner is that the petitioner has falsely been implicated in this case. Nothing has been recovered from the possession of the petitioner. The petitioner is in custody since 24.07.2017 having clean antecedent. It is further submitted that other co-accused have been granted bail
Patna High Court Cr.Misc. No.39551 of 2017 (3) dt.24-08-2017 2/2 by different Co-ordinate Benches of this Court. Heard learned A.P.P. also.
kHaving considered the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Patna in connection with Special Case no.3289 of 2017 arising out of Kotwali P.S.Case no. 317 of 2017, subject to the condition that one of the bailors should be a local person having sufficient immovable properties within the jurisdiction of court concerned.
