====================================================== CORAM: HONOURABLE MR. JUSTICE V.N. SINHA ORAL ORDER 13-10-2015 Heard learned counsel for the petitioners and the State.

Petitioners are apprehending their arrest in connection with a case registered for the offence under Section 307, 354A and other allied Sections of the Penal Code. It appears husband of the informant was being assaulted by these petitioners. She came to rescue her husband. Petitioner No. 1 is said to have given dagger blow to Mustafa Mian. Petitioner Nos. 2 to 4 have also assaulted the informant, her husband and Mustafa Mian but the injuries caused by Petitioner

Patna High Court Cr.Misc. No.40469 of 2015 (2) dt.13-10-2015 Nos. 2 to 4 is neither serious nor grievous. So far Petitioner No. 1 is concerned he is the author of dagger blow on Mustafa Mian.

In the circumstances, let petitioners, named above, surrender in the court below within four weeks from the date of receipt/production of a copy of this order in the court below, thereafter case of Petitioner No. 1 be considered in accordance with law taking into account nature of the injury attributed to him. So far Petitioner Nos. 2 to 4 are concerned, they be released on bail on furnishing bond of Rs. 5,000/- (five thousand) each with two sureties of the like amount each to the satisfaction of Sri Vivek Kumar Singh, Judicial Magistrate, 1st Class, Gopalganj in connection with Manjhagarh P.S. Case No. 191/2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
