The petitioner apprehends arrest in a case registered for the offences punishable under sections 304-B, 328, 498-A/34 of the Indian Penal Code and section 3⁄4 of the Dowry Prohibition Act.

The informant alleged that her daughter was married to one Manoj Kumar, elder son of Ram Babu Singh on 16.01.2013 but her husband started demanding motor cycle. The informant alleged that on 07.06.2015 Manoj Kumar and his family members including the petitioner killed her daughter. It is submitted that deceased Sapna died on 07.06.2015. Manoj Kumar, husband of the deceased, informed the informant and also informed the police. The police came on 08.06.2015, inquest was prepared. The dead body was sent for post mortem examination. It is submitted that the informant also participated in the cremation of the deceased and after three days of the occurrence the informant filed this case. Learned counsel for the State submitted that Manoj Kumar had also killed his earlier wife by administering poison and the second wife of Manoj Kumar also died on account of poison.

Having considered the fact that the petitioner is mother-in-law of the deceased and no specific allegation is made against her, petitioner above named, in the event of arrest or surrender in the court below within four weeks from the date of receipt/production of a copy of this order, shall be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri V. K. Chaubey, Judicial Magistrate, 1st Class, Muzaffarpur in connection with Baruraj P.S. Case No. 49 of 2015 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure, 1973.
