In this case, the petitioner is apprehending her arrest in connection with Industrial Area P.S. Case No. 194 of 2018 registered for offences under sections 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018. As per prosecution story, the police raided the house of Lalan Chaudhary, husband of the present petitioner, and from the garage, Scorpio vehicle was found. On search, 36 liters of illegal liquor was recovered from the back of the vehicle. The said vehicle is standing in the name of the present petitioner. The people of the locality informed the police that the petitioner and her husband are engaged in illegal trade of liquor.

No.39668 of 2019(2) dt.28-06-2019 2/2 Learned counsel for the petitioner submits that the petitioner is a house wife, she lives separately from her husband and she has no concern with the alleged Scorpio vehicle. Looking to the entire facts and circumstances of the case, let the petitioner, above named, in the event of her arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge IInd cum Special Judge, Vaishali at Hajipur in connection with Industrial Area P.S. Case No. 194 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to condition that whenever the police will call the petitioner for investigation/interrogation, she will remain present and if she would not present herself, the privilege of grant of anticipatory bail shall be deemed to have been canceled.
