The petitioner seeks bail in a case registered for the offence punishable under Section 363 & 366A of the Indian Penal Code.
The prosecution case, in brief, is that the daughter of the informant is said to have been kidnapped by the petitioner in association of other co-accused.
It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. He is quite innocent and has been falsely implicated in this case due to dirty village politics. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. As a matter of fact, the victim girl was not kidnapped rather she herself had
Patna High Court CR. MISC. No.38028 of 2020(3) dt.08-03-2021 2/2 eloped from the house and suo motu returned back home. The petitioner has no criminal antecedent and has been languishing in custody since 28.07.2020.
Learned APP for the State opposed the bail petition.
In the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. The prayer for bail is hereby rejected. However, the petitioner is at liberty to renew his prayer for bail after framing of charge.
