JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 17-02-2022 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 302 of the Indian Penal Code.
As per the prosecution case, this petitioner, who happens to be husband of the informant's sister, killed her by assaulting with bricks and throttling.
Learned counsel for the petitioner denies the allegation and submits that in fact informant's sister fell down from the roof and died of head injuries on the spot. Petitioner is in custody since 28.3.2021.
Learned counsel for the State opposes the prayer for bail and submits that the preceding night petitioner had quarreled with the victim, thereafter he assaulted with bricks on her nose and mouth leading to her death. Post mortem report reveals that the victim sustained grievous injuries on her nose and the mouth. Doctor has further opined that the victim died of the aforesaid injuries.
