The petitioner seeks bail in a case instituted for the offences under Sections 302 and 201/34 of the Indian Penal Code.
It has been alleged that deceased was killed somewhere else and his dead body was found lying in the field. Petitioner has been implicated in the present case during investigation but the materials whatever collected during investigation do not connect the petitioner with the alleged crime. Having considered the facts and circumstances of the case, let petitioner, Guriya Devi, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two
Patna High Court Cr.Misc. No.39308 of 2016 (4) dt.25-10-2016 sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka in connection with Bounsi P.S. Case No. 7 of 2015, subject to the conditions that (i) one of the bailors shall be a close relative of the petitioner i.e. father, mother, husband or son but it will be subject to submission of the charge sheet and (ii) If police submits the charge sheet against the petitioner, she will surrender before the court below and makes a prayer for fresh bail.
