JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-10-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered under Sections-272, 273 of the Indian Penal Code and 47 of Bihar Amendment Excise Act.

Sixty bottles of Indian made foreign liquor, containing 750 ml. each in 15 bottles and 375 ml. each in 48 bottles, were recovered from a Maruti Van. Petitioners were caught by the informant and other officials, while they were trying to flee from there after leaving the aforesaid Maruti. Petitioners are in jail custody since 29-07-2016 and they do not have any criminal antecedent.

Submission on behalf of petitioners is that petitioners

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioners named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Barh N.T.P.C. P.S. Case No. 35 of 2016 to the satisfaction of learned Additional Chief Judicial Magistrate, Barh, Patna.
