The petitioner seeks bail in Kaluahi P.S. Case No. 190 of 2018, instituted for the offence under Section(s) 307, 34 of the Indian Penal Code, Section 27 of the Arms Act and Sections 3⁄4 of Explosive Substance Act.

Counsel for the petitioner submits that in the written report there is specific allegation against Dinesh Yadav of causing firearm injury to the informant. He further submits that petitioner is not named in the written report. The name of petitioner has come subsequently during investigation that he was member of unlawful assembly.

Petitioner is in custody since 30.1.2019.

Considering the aforesaid facts and circumstances of

Patna High Court CR. MISC. No.39081 of 2019(2) dt.01-07-2019 2/2 the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri M. Dubey, learned Judicial Magistrate, Madhubani, Distt. Madhubani, in connection with Kaluahi P.S. Case No. 190 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
