JUSTICE BIRENDRA KUMAR ORAL ORDER 14-12-2016 Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the informant. Petitioner is accused in connection with Laukariya P.S. Case No. 113 of 2015 registered under Sections 366A and 376 of the I.P.C.
The F.I.R. was lodged with allegation against the petitioner that he forcibly abducted Radha Kumari, daughter of the informant, with intention to marry her and thereafter, he forcibly ravished her.
On notice, the informant is appearing in this case and it has been informed that both are going to marry within three months from today.
Considering the aforesaid undertaking of the
Patna High Court Cr.Misc. No.42442 of 2016 (4) dt.14-12-2016 2/2 petitioner, let the above named petitioner be released on Provisional Bail for three months on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Bagaha, West Champaran in connection with Laukariya P.S. Case No. 113 of 2015, subject to the condition that he would marry with the victim girl within a period of three months from the date of receipt/production of a copy of this order and thereafter, the Court below shall consider the confirmation of Provisional Bail of the petitioner.
