JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 14-09-2021 Heard the parties through virtual court proceedings. Vide order dated 10.08.2021, report was called for from the court of learned C.J.M., Siwan in Basantpur P.S. Case No. 333 of 2019 regarding stage of trial in the present case which is received and tagged as Flag "A" to this petition.
In compliance thereof, a report dated 27.08.2021 sent by the ADJ VIth Civil Court, Siwan has been received and at Flag "A" to this application. Learned Judge, apart from the other facts, has stated that charges in this case under Sections 376/417 IPC have been framed on 21.01.2021, one prosecution witness has been examined on 08.03.2021 and deffered for the further cross-examination in the meantime the progress of the trial of this case became slow due to COVID 19 and lock-down.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner on bail. The prayer for bail of the petitioner is
Patna High Court CR. MISC. No.3942 of 2021(6) dt.14-09-2021 2/2 rejected.
However, the learned Trial Court is directed to conclude the trial as expeditiously as possible preferably within one year from the date of receipt/production of a copy of this order and S.P., Siwan is directed to ensure production of the witnesses in the case on each and every date fixed without fail.
Let a copy of this order be communicated to S.P., Siwan by fax for needful.
