JUSTICE SUDHIR SINGH ORAL ORDER 15-12-2016 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case instituted for the offences under Section 7 of the Essential Commodities Act. Accusation is that 144 bags of paddy containing 40 kgs each bag total 57.60 quintal and 299 bags of rice containing 50 kgs each total 149.50 quintals were recovered from the truck, of which the petitioners were the driver and khalasi.
It has been submitted on behalf of the petitioners that the petitioners are in custody since 30.9.2016 and the charge sheet has been submitted in the present case. The petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. As per the prosecution
Patna High Court Cr.Misc. No.51986 of 2016 (2) dt.15-12-2016 2/2 case, 144 bags of paddy containing 40 kgs each bag total 57.60 quintal and 299 bags of rice containing 50 kgs each total 149.50 quintals were loaded on the truck. The petitioners are the driver and khalasi of the said truck, who have no concern with the said paddy and rice.
On behalf of the State, it is submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioners above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Madhepura P.S. case No.621 of 2016.
