JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-08-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered under Sections 272 and 273 of the Indian Penal Code and 30(a) of Bihar Prohibition and Excise Act, 2016.

Allegation against the petitioner is that there was recovery of 212 Ltrs. of foreign liquor from the possession of the petitioner. He is named in the FIR.

Submission of the learned counsel for the petitioner is that other co-accused, who are similarly situated have been granted bail. It is also submitted that the person who was arrested at the spot has also been released on bail by this Court. The petitioner is in custody since 27/07/2017.

Having considered the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge IInd-cum- Special Judge (Excise) Rohtas at Sasaram in connection with Bikraamganj P.S.Case No. 129 of 2017, subject to the condition that one of the bailors should be a local person having sufficient immovable properties within the jurisdiction of the court.
