The petitioner is apprehending arrest in a case registered for the offences punishable under Section 47a of the Excise Act.

It is alleged that 50 literes of country made liquor apart from materials and equipments for manufacturing the illegal liquor were recovered from the house of the petitioner. It is submitted by learned counsel for the petitioner that the recovery is from the joint family house of the petitioner. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

The aforesaid facts constitute ground for

Patna High Court Cr.Misc. No.37852 of 2015 (2) dt.21-09-2015 2/2 consideration of prayer for regular bail.

Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Case No.CC50 of 2014, pending before the learned CJM, Araria.

With the above observation, this application is, accordingly, disposed off.
