====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 27-09-2024 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State.

2. The petitioner is seeking regular bail in connection with Bahadurpur P.S. Case No. 13 of 2024 for the offences punishable under Sections 341, 323, 364(A), 504, 506/34 of the Indian Penal Code.

3. As per allegation, when the informant along with his friend Bharav Sada and Pramod Sada was coming from village-khaira and reached near khaira Bhanhar Bridge, five persons sitting in a Scorpio came and forcibly get him seated on the said Scorpio. His friends were also assaulted and pushed by them, as a result of which, they fell down. The petitioner is said to have demand ransom of Rs. 5,00,000/- otherwise, he will have to face dire consequences.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

Patna High Court CR. MISC. No.45450 of 2024(4) dt.27-09-2024 2/2 this case. He has further submitted that the petitioner is covillager of the informant. There is previous enmity between informant and the petitioner. He has also submitted that coaccused Rakesh Kumar Yadav was arrested at the spot and he was granted bail by the learned Court below and the case of the petitioner is on better footing.

5. On the other hand, learned APP for the State has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances especially the fact that the case of the petitioner is on better footing than that of co-accused Rakesh Kumar Yadav, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Darbhanga in connection with Bahadurpur P.S. Case No. 13 of 2024, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
