JUSTICE SANJAY PRIYA ORAL ORDER 19-07-2017 Heard learned counsel for the petitioner and learned counsel for opposite party No. 2.

The petitioner seeks bail in Parsauni P.S. Case No. 121 of 2015 registered for the offence under Sections-498A, 323, 504, 506 of the Indian Penal Code.

It is submitted on behalf of the petitioner that the petitioner is ready to keep his wife with him. The wife is present in court with her minor child. She has stated that she has two minor daughters after the marriage. She has stated that she wants to live with the husband.

In such circumstances, the petitioner is directed to be released provisionally for a period of six months on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to

Patna High Court Cr.Misc. No.32118 of 2017 (3) dt.19-07-2017 the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Parsauni P.S. Case No. 121 of 2015 subject to conditions that both the bailors should be close relative of the petitioner.

The petitioner at the time of furnishing bail bonds in the court below, will file an affidavit to this effect that he will keep his wife and minor daughters with full dignity and care and the court below will monitor the developments in the relation by calling both husband and wife every month and in the event, the court below is satisfied that the petitioner is keeping his wife and minor daughters properly, he will confirm the provisional bail granted to the petitioner.

In the event the wife makes complain against the petitioner during period of monitoring about committing physical and mental torture by him, the court below will cancel the provisional bail of the petitioner.
