2. The petitioner apprehend his arrest in connection with Fulwaria (Phulwarya) P.S. Case No. 49 of 2025 instituted under Sections 126(2), 115(2), 109, 303(2), 352, 351(2), 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. As per the prosecution case, the petitioner had shot fire upon the informant but due to misfire, the life of the informant saved. It is further alleged that the petitioner has also entered the pistol in the mouth of the informant.

4. Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case due to land dispute between the parties. He further submits that the injuries to the person injured are simple in nature. As such the

Patna High Court CR. MISC. No.40213 of 2025(2) dt.27-06-2025 2/2 injury report does not support the prosecution case. He further submits that petitioner has one criminal antecedent in which he is acquitted and he undertakes to cooperate in the investigation and trial.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount to each to the satisfaction of the learned Judicial Magistrate 1stClass, Begusarai in connection with Fulwaria (Phulwarya) P.S. Case No. 49 of 2025, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
