JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 08-07-2021 As prayed for, through video conferencing, let the learned counsel for the petitioners remove the defect(s), as pointed out by the office vide it's note, dated 22.12.2020, within four weeks of starting of the Court proceeding in physical mode properly.

Heard the parties through video conferencing. The petitioners seek pre-arrest bail in connection with Nayagaon P.S. Case No. 36 of 2020, registered under Sections 341, 323, 324, 304B and 201/34 of the Indian Penal Code. The accusation is that the informant, Mahendra Pandit, performed marriage of his daughter, Sangeeta Kumari, with Surendra Pandit, son of Rajdeo Pandit of village Rasulpur. After marriage his daughter was being tortured for demand of rupees one lakh. In the meantime, the daughter of the informant was blessed with a baby, who is of one year. Lastly, she was

Submission is that all the three petitioners are brotherin-law and gotnis of the deceased daughter of the informant and they used to live separately from Surendra Pandit, but, with ulterior motive they have falsely been implicated in this case. Further, submission is that Surendra Pandit and Rajdeo Pandit, husband and father-in-law of the deceased daughter of the informant, are in custody.

Having regard to the facts and circumstances of the case, let the petitioners, above named, in the event of arrest/surrender, within a period of four weeks from today, in connection with Nayagaon P.S. Case No. 36 of 2020 shall be released on bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, VI, Saran at Chapra, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
