The petitioner has preferred this application for grant of regular bail in a case registered under section 307 and other sections of the Indian Penal Code.

As per the prosecution case, as a result of land dispute between the parties, it is stated that 20 named accused persons including the petitioner herein came variously armed. The petitioner is said to have assaulted Rina Devi on head with a farsa.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case because of land dispute between the parties which is evident from the FIR itself. The injury on Rina Devi allegedly given by the petitioner has been found to be simple in nature. The

Having heard learned counsel for the parties and taking into consideration the facts of the case, the petitioner having remained in custody for 1 year 3 months and injury on Rina Devi attributable to the petitioner having been found to be simple in nature, the Court directs the petitioner to be enlarged on bail in connection with Jaynagar P.S. Case no. 169 of 2020, corresponding to C.R.I no. 887 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned SubDivisional Judicial Magistrate, Madhubani.
