This is an application for bail in connection with Banka P.S.Case No. 515 of 2016 registered for the offences punishable under Sections 395 and 397 of the Indian Penal Code. Petitioner is not named in the FIR and it appears that his name transpires on the basis of his own confession and there is recovery of Rs.16,500/- from his house.

It has been submitted on behalf of the petitioner that the articles have not been put on T.I.Parade and there is nothing against the petitioner except the said recovery and he is in custody for more than one year.

Heard learned APP also, who has opposed the prayer for bail.

Patna High Court Cr.Misc. No.33676 of 2017 (2) dt.26-07-2017 2/2 Having heard both sides and in view of allegation as well as the fact that he has made his own confession, I am not inclined to grant bail to the petitioner.

However, as the petitioner is in custody for more than one year, learned trial court is directed to expedite the trial and try to conclude it within nine months and at the same time Superintendent of Police, Banka is directed to ensure the presence of the witnesses in court on the date fixed so that the trial be concluded within the said period.

With the above observation, this application is dismissed.
