2. The petitioner is in custody in connection with Derni P.S Case No. 214 of 2024 registered for the offences punishable under Sections 309(4) of the BNS.

3. As per allegation in the FIR, petitioner along with other co-accused persons have committed loot and looted motorcycle and Rs. 2,500/- from the informant.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next submits that name of the petitioner figured from the confessional statement of the co-accused, namely, Ashwani Kumar. He further submits that nothing has been recovered from the conscious possession of the petitioner, moreover, no TIP has been conducted. He also submits that investigation has already been completed and charge-sheet has already been submitted.

5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.

On perusal of the FIR, impugned order dated 14.05.2025, it appears that petitioner name has been figured from the confessional statement of the co-accused namely Ashwani Kumar and investigation has already been completed and charge-sheet has also been submitted and also considering the aforesaid facts and circumstances of the case and submissions made on behalf of the learned counsel for the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class in connection with Derni P.S Case No. 214 of 2024 subject to condition that petitioner shall appear physically each and every date fixed by the Trial Court till conclusion of the Trial.
