The petitioner seeks bail in a case instituted under Sections 399, 402, 414 of the Indian Penal Code and 25(1b)A/26/36 of the Arms Act. One country made loaded pistol along with one live cartridge and one mobile are said to have been recovered from the possession of the petitioner.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 03.01.2016. The charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. One loaded country made pistol along with one cartridge is said to have been
Patna High Court Cr.Misc. No.42234 of 2016 (2) dt.03-10-2016 2/2 recovered from the possession of the petitioner. There is no compliance of section 100 of the Cr.P.C. The other co-accussed has been granted bail vide Annexure-3 to the present application. On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Railway Judicial Magistrate, Ara, in connection with Buxar Rail P.S. Case No. 01 of 2016.
