====================================================== CORAM: HONOURABLE MR. JUSTICE V.N. SINHA ORAL ORDER 15-10-2015 Heard learned counsel for the petitioner, the State and the counsel for the complainant.

Petitioner is apprehending his arrest in connection with a complaint case registered for the offences under Sections 406, 420, 120-B of the Penal Code. It is submitted on his behalf that he shall deposit a sum of Rs. 65,000/- in the court below within a period of four weeks from the date of receipt/ production of a copy of this order in the court below. If such deposit is made, petitioner, named above, be admitted to the privilege of bail on furnishing bail bond of Rs. 5,000/-(Five Thousand) with two sureties of the like amount each to the satisfaction of Judicial

Patna High Court Cr.Misc. No.41467 of 2015 (2) dt.15-10-2015 2/2 Magistrate, Ist Class, Patna in connection with Complaint Case No. 1098(C)/2013. The amount deposited may be withdrawn by the complainant on furnishing sufficient security, may be landed property, but such withdrawal will be subject to the result of the disposal of the complaint case. In the event, complaint is dismissed the complainant shall refund the aforesaid amount to the petitioner with 18% interest from the date of its receipt. In case, prosecution succeeds complainant shall not refund the amount. The refund of balance amount of Rs. 40,000/- with 18% interest to the complainant shall depend upon the result of the prosecution.

In case, prosecution succeeds petitioner herein as also his other partner shall refund the aforesaid amount with 18% interest from the date of complaint. For a period of four weeks no coercive steps be taken against the petitioner. In case, amount is not deposited, the court below shall ensure arrest of the petitioner after expiry of four weeks. Hearing of the complaint case be expedited and concluded within a period of nine months from today. This petition is, accordingly, disposed of.
