Petitioner seeks regular bail in connection with Ganga Bridge P.S. Case No. 150 of 2020 registered for the offence under Section 392 / 411 of the IPC.

The allegation in nutshell is that while the informant was sleeping in his Bolero vehicle near Ganga Bridge upon which shuttering materials were loaded, and two unknown persons arrived there and on the point of pistol looted away his vehicle along with mobile phone and cash of Rs. 4000/-. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case only on the basis of his self inculpatory confessional statement recorded in Hajipur Town P.S. Case No. 74 / 2021 and nothing has been recovered from the possession of the petitioner. Petitioner has not been put on T.I. Parade , he is in custody since 23-02-2021, charge sheet has also been submitted in the matter and similarly situated co-accused / Raja Yadav @ Prince Kumar has been

Patna High Court CR. MISC. No.51400 of 2021(2) dt.09-02-2022 2/2 granted bail by this court in Cr. Misc. No. 46521 of 2021. Having regard to the submissions made by the parties and taking into consideration the materials on record, the fact that nothing has been recovered from the possession of petitioner, he is in custody since 23 / 2 / 2021 , charge sheet has also been submitted in the matter, similarly situated co-accused has been enlarged on bail by this court and trial is not likely to be concluded in near future due to Covid 19 pandemic, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Vaishali at Hajipur in connection with Gangabridge P.S.
