Petitioner is in custody since 22.09.2016 in connection with Maner P.S. Case No. 442 of 2015 registered under Sections 364, 302, 201 of the Indian Penal Code.

The informant, brother of the deceased, alleged that his brother went along with Bachcha Rai and two others, but his brother did not return. On the next day his dead body was found by this side of river Ganga.

Learned counsel for the petitioner has submitted that the petitioner is not named in the First Information Report rather the name of the petitioner has come during course of investigation on statement of one Ras Bihari Mahto, brother-in-law of the deceased, who has stated that the deceased was last seen near a Saloon in Maner Bazer
Patna High Court Cr.Misc. No.1366 of 2017 (2) dt.17-01-2017 with Baiju Rai, Bachcha Rai, Gopi Rai and this petitioner also. Except this nothing is available against this petitioner to prove his implication in the alleged occurrence. Moreover, co-accused, Baiju Rai, has already been granted bail by a co-ordinate Bench of this Court in Cr. Misc. No. 33005 of 2016 5.
Considering the facts and circumstances of the case and nature of accusation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand rupees only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Danapur in connection with Manner P.S. Case No. 442 of 2015.
