ANJANA MISHRA ORAL ORDER 18-08-2018 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is in custody since 13.05.2018 in connection with Jehanabad P.S. Case No. 41 of 2018 for the offence registered under Sections 147, 148, 149, 325 and 307 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that though it is alleged that the petitioner was allegedly brandishing fire arms, there is no allegation of anybody having been injured or the petitioner has actually fired from his weapons which he is alleged to have been carrying. It is further submitted that only because there was a scuffle in the locality, the petitioner has been taken into custody and kept behind the bars.

No.42075 of 2018 (4) dt.18-08-2018 2/2 Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jehanabad in connection with Jehanabad P.S. Case No. 41 of 2018.
