Petitioner seeks bail in connection with Nautan P.S.Case No. 104 of 2016 registered under Sections- 272, 273/34 of the Indian Penal Code and section 47 of the Excise Act.
The allegation against the petitioner is that of carrying illegal wine.
Learned counsel for the petitioner submits that petitioner has no criminal antecedent. It is further submitted that two other persons who were carrying wine fled away after leaving motorcycle and wine and this petitioner who was coming through road was apprehended by the police. It is
Patna High Court Cr.Misc. No.49370 of 2016 (2) dt.13-12-2016 further submitted that the petitioner is in custody since 04.08.2016 for his no fault.
Considering the facts and circumstances of the case, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-XII, Siwan in connection with Nautan P.S. Case No. 104 of 2016.
