This application is for grant of regular bail in connection with Islampur P.S.Case no.77 of 2006 for the offences under Sections 147, 148, 149, 452, 341, 342, 324, 307, 302/380 of the Indian Penal Code and Section 27 of the Arms Act. Allegation against the petitioner is of firing on the son of the informant, which hit on his neck and there is allegation against the other co-accused of firing on the wife of the informant due to which he succumbed injuries.

Submission of the learned counsel for the petitioner is that he is in custody since 1.12.2017 and there is no allegation of firing on the deceased against the petitioner. Heard learned A.P.P. also.

No.41090 of 2018 (4) dt.25-09-2018 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage, however, if the trial is not concluded within a period of six months, the learned trial court shall release the petitioner on bail in connection with S.T.No.94/2018 (arising out of Islampur P.S.Case no.77of 2006) to his own satisfaction. With the aforesaid observation, this application is disposed of.
