Petitioner apprehends arrest in connection with Jandaha P.S. Case No. 121 of 2021 registered for the offence punishable under sections 420, 467, 468, 471, 120B of the Indian Penal Code and sections 30A/36/41(1) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case on basis of confessional statement of the co-accused. Nothing has been recovered from the conscious possession of this petitioner. Petitioner has no concern either with the vehicle in question or the seized illicit liquor.

No.51255 of 2021(2) dt.08-04-2022 2/2 Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 2nd Additional Sessions Judge-cum-Special Judge, Excise, Vaishali at Hajipur in connection with Jandaha P.S. Case No. 121 of 2021 subject to the conditions laid down under section 438(2) Cr.P.C.
