JUSTICE ARUN KUMAR ORAL ORDER 09-02-2017 Heard learned counsel for the petitioner and the State. Petitioner is languishing in custody in connection with a case registered under Sections 363 and 366(A) of the Indian Penal Code.

The allegation against the petitioner is that he enticed away 11 years old daughter of the informant.

It is submitted that the girl was not recovered from possession of the petitioner and she in the statement recorded under Section 164 Cr. P.C. states that she used to go to the petitioner for witchcraft practices as he has knowledge of witchcraft practices. In the said statement, she also admits her age in between 14-15 1⁄2 years and in her statement does not allege of sexual exploitation by the petitioner.

No.514 of 2017 (4) dt.09-02-2017 2/2 Considering the aforesaid facts and circumstances, the petitioner, namely, Sudhir Kumar @ Sunil Kumar @ Lalka Baba @ Unil Kumar, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sri Manoj Kumar, VA.C.J.M., Patna City, Patna, in connection with Sahjananpur P.S. Case No. 51 of 2016.
