The petitioner seeks bail in RPF Mokama P.S. Case No. 2/2018, instituted for the offence under Section 3RP (U.P.) Act. The instant case has been filed on the basis of confessional statement of petitioner. As per prosecution case, the informant on getting information reached near Hathidah Link and saw the petitioner carrying a plastic bag. On enquiry, 23 pendrol clips were recovered from the aforesaid plastic bag and seizure-list was prepared. Copy of seizure-list was given to the petitioner and thereafter F.I.R. was lodged.

Learned Additional P.P. has submitted that the petitioner has criminal history.

Patna High Court Cr.Misc. No.41626 of 2018 (3) dt.24-09-2018 2/2 Counsel for petitioner has submitted that petitioner is on bail in all those cases.

The petitioner is in custody since 08.04.2018. Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Railway, Patna in connection with RPF Mokama P.S. Case No. 2/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
