This is an application for bail in connection with Mahammadpur P.S.Case No. 26 of 2016 registered for the offences punishable under Sections 10, 13, 16(B), 18, 19, 20 of Unlawful Activities (Prevention) Act and 3, 4 & 5 of Explosive Substance Act.
Petitioners are not named in the FIR and from the impugned order it appears that their names transpire in the confessional statement of co-accused and petitioners have criminal antecedents.
Submission of learned counsel for the petitioners is that except confessional statement there is nothing against them and
Patna High Court Cr.Misc. No.46735 of 2017 (2) dt.11-10-2017 2/2 they are in custody for five months.
Heard learned APP also.
Having heard both sides and in view of the fact that petitioners have criminal antecedents, I am not inclined to grant bail to the petitioners.
However, once charge has been framed in this case against the petitioners, learned court below will release the petitioners on bail to its own satisfaction on the condition that they will co-operate in trial, otherwise their bail bonds shall be cancelled.
With the above observation, this application is disposed of.
