At the outset, the petitioner seeks permission to correct the date of custody which is inadvertently written as 06.06.2017 in paras 1 and 12 of the petition to be read as 09.07.2017.

The petitioner is permitted to make necessary correction during the course of the day.

The petitioner seeks regular bail in connection with Barhat PS case no. 28 of 2017 registered for the offences punishable under Sections 147, 148, 149, 323, 324, 307, 504, 506 of Indian Penal Code.

The accusation against the petitioner and other accused persons is regarding assaulting of the prosecution party and the specific allegation against the petitioner herein is

Patna High Court Cr.Misc. No.45491 of 2017 (2) dt.19-09-2017 2/2 assaulting one Yamuna Pandit and Usha Devi with lathi. The learned counsel for the petitioner submits that petitioner has clean antecedent, the injuries on the person of the informant and others are simple in nature and the petitioner is in custody since 09.07.2017.

In the facts and circumstances of the case, I deem it fit and appropriate to direct the release of the petitioner on regular bail immediately upon completion of 03 months from the date of custody i.e. from 09.07.2017 to the satisfaction of Sri Narendra Kumar Yadav, learned Judicial Magistrate 1st class, Jamui in Barhat PS case no. 28 of 2017 on such terms as may be found up-to-date by the learned trial court.

With the aforesaid observation, the instant petition is disposed of.
