JUSTICE SATYAVRAT VERMA ORAL ORDER 24-03-2022 Heard Shri Yogesh Chandra Verma, learned senior counsel for the petitioner, assisted by Ms. Kumari Anupan, learned counsel and learned Central Government counsel for the Union of India.

Petitioner seeks bail in connection with N.C.B. Case No. 06 of 2021 registered for the offences under Sections 8(c), 20(b)(ii)(c), 25 and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Learned senior counsel for the petitioner submits that the petitioner is in custody since 07.04.2021, charge-sheet has been submitted and has antecedent of one case under the

Patna High Court CR. MISC. No.52367 of 2021(6) dt.24-03-2022 2/3 N.D.P.S. Act.

Learned senior counsel for the petitioner submits that the informant alleges that a secret information was received that a truck is carrying huge quantity of ganja, accordingly a team was constituted and N.C.B. Officials saw the truck coming and stopped the truck and the driver Girwardhari Pandey disclosed that the truck was loaded with coal and 10 quintals of ganja. It is further alleged that the driver and the co-accused Rajendra Ram further stated that ganja was to be received by Sadhu Yadav and Dharamraj Singh @ Junna (petitioner) who will come to Aurangabad tomorrow.

Learned senior counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and at best from the allegation it would manifest that the name of this petitioner transpired based on the confessional statement of the driver of the truck and co-accused who were found sitting in the truck. Learned senior counsel submits that confessional statement as such does not have any evidentiary value. Learned Central Government counsel opposes the bail application of the petitioner and submits that though the name of this petitioner came in the confessional statement of the truck driver but then he is also an accused from before in a case under

Patna High Court CR. MISC. No.52367 of 2021(6) dt.24-03-2022 3/3 the N.D.P.S. Act.

Considering the submissions made by the learned Central Government counsel and in the nature of allegations and that petitioner is having an antecedent under the N.D.P.S. Act, the Court, for the present, is not inclined to grant bail to the petitioner. His prayer for bail is thus rejected. (Satyavrat Verma, J) Rishi/- U T
