The petitioner apprehends his arrest in Buxar Muffasil P.S. case No. 85 of 2019 registered under Section 30(a), 34(b) of the Bihar Prohibition & Excise (Amendment) Act, 2018. The police got information that petitioner and others were illegally selling and on such raid was conducted. From the hut situated near the house of petitioner 62 bottles each containing 200 ml. liquor was recovered.

The learned counsel for the petitioner submits that no villager is seizure list witness. Search and seizure is not made in accordance with law but it appears that recovery was made from the hut situated near the house of the petitioner and petitioner is alleged to have been selling the liquor.

Patna High Court CR. MISC. No.40124 of 2019(2) dt.02-07-2019 2/2 Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
