2. Petitioner seeks regular bail in connection with Warisaliganj P.S. Case No. 97/ 2025 dated 17.02.2025 registered for the offence(s) punishable under Section(s) 319(2), 318(4), 338, 336(3), 340(2), 61(2) and 3(5) of the BNS and sections 66(B) and 66(D) of the I.T. Act.

3. The main submissions advanced by the petitioner's counsel are that the petitioner has fair and clean antecedent and languishing in jail since 18.02.2025, the FIR clearly shows that the main allegation is against co-accused, Deepak Kumar, who allegedly cheated the innocent persons on the pretext of cheaper loan, and the said allegation is not against the petitioner and as

No.41631 of 2025(2) dt.11-07-2025 2/2 per the prosecution's story, the petitioner was simply found with the co-accused, Deepak Kumar and the alleged bank account in which the amount obtained by way of cheating was deposited found to be in the name of the co-accused, Deepak Kumar.

4. Learned APP for the state has opposed the bail prayer of the petitioner.

Considering the aforesaid submissions advanced by the petitioner's counsel and mainly the petitioner's young age and his fair and clean antecedent as well as custody period and also completion of investigation against him, this court is inclined to release the petitioner on bail. Accordingly, let the petitioner named-above be released on bail in connection with Warisaliganj P.S. Case No. 97/ 2025 on furnishing bail bond of Rs.20,000/-( Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned. (Shailendra Singh, J) BKS/- U T
