=========================================================== CORAM: HONOURABLE THE CHIEF JUSTICE ORAL JUDGMENT Date: 06-07-2017 Keeping in view the show-cause filed by the respondents, it is seen that for various reasons as are indicated in the show-cause in spite of efforts made, the appeal could not be decided and now the appeal is pending consideration before the Additional Municipal Commissioner, Revenue and it is indicated that the parties have been noticed and the matter is kept for disposal on 19.07.2017 and in the show-cause notice six weeks' time for disposal of the appeal is sought for.
Keeping in view the aforesaid statement made by the respondents, for the present, without initiating any coercive action,
Patna High Court MJC No.1049 of 2014 dt.06-07-2017 2/2 the competent authority, namely, the Additional Municipal Commissioner, Revenue, before whom the matter is pending, is directed to decide the same on 19.07.2017 or positively on or before 15th of August, 2017. In case the applicant or the respondents do not cooperate, the authority shall be free to proceed in the matter in accordance with law without granting any adjournment in the matter. In case the authority does not decide the matter within the time stipulated by this Court, liberty shall be available to the applicant to file application and this order shall be recalled and the matter taken up for reconsideration.
With the aforesaid, the petition stands disposed of for the present.
