The petitioner, in the present case, is seeking regular bail in connection with Amnour P.S. Case No.118 of 2016, registered for offences alleged under Sections 304B/34 of the Indian Penal Code.
The petitioner is the husband of the deceased and is in custody since 04.10.2016.
Learned counsel for the petitioner submits that, in the present case, charge-sheet has already been submitted, however till date the case has not been committed to the court of Session and the trial has not begun.
Learned APP opposed the prayer for bail and
Patna High Court Cr.Misc. No.38532 of 2017 (2) dt.19-08-2017 submits that it would be in the fitness of the case to direct the trial court to conclude the trial.
Considering the fact that the petitioner is the husband and the death has taken place within a period of two months after marriage, I am not inclined to grant regular bail to the petitioner. However, learned trial court is directed to expedite the trial and conclude the same preferably within a period of nine months from the date of receipt/production of a copy of this order. For this purpose, the necessary orders of commitment shall be passed by the court below immediately on receipt of the order of this Court.
The application stands dismissed.
