JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-10-2015 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 341, 323, 325, 353, 379, 427 of the Indian Penal Code. The prosecution case is that the students whose attendance were not up to 75 per cent were not given the benefits of bicycle and dress scheme. In protest thereof the mob came, entered into the room of the school and took away play materials worth Rs. 1,60,000/-.The petitioners were identified as the persons who made protest and entered into the school. It is submitted by learned counsel for the petitioners that accusation is against the mob and the protest
Patna High Court Cr.Misc. No.40031 of 2015 (2) dt.06-10-2015 2/2 was made by the mob for not giving the bicycle and the dress under the scheme and misappropriating the money. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Sherghati, Gaya in connection with Dumaria P.S. Case No. 1 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
