====================================================== CORAM: HONOURABLE MR. JUSTICE SHAILENDRA SINGH ORAL ORDER 27-06-2025 Heard Kamlesh Kumar Pathak, learned counsel for the petitioners and Mr. Ramesh Chandra, learned APP for the State.
2. The petitioners apprehend their arrest in connection with Complaint Case No. 333 of 2023 dated 13.07.2023 registered for the offences punishable under sections 120-B, 376, 511, 450 and 34 354-B and 506 of the Indian Penal Code in which cognizance has been taken under sections 354-B and 506 of the Indian Penal Code.
3. The main submissions advanced by the learned counsel for the petitioners are that the instant matter relates to a complaint filed by the O.P. No. 2 against the petitioners with revengeful attitude on account of a previous case bearing Bihpur P.S. Case No. 96 of 2023 lodged by the brother of the petitioners against
Patna High Court CR. MISC. No.39550 of 2025(2) dt.27-06-2025 2/2 the son of the complainant and secondly, the alleged occurrence is said to have taken place on 16.02.2023 but the complaint was filed on 13.07.2023 though in the complaint the complainant tried to explain the delay with saying that she gave a written information to the SHO Bhawanipur and her case was not lodged but the said fact is completely vague. It is lastly submitted that the learned trial court has taken cognizance of the offences under sections 354-B & 506 of the IPC which are triable by the First Class Magistrate.
4. Learned APP for the State has opposed the prayer of the petitioner.
5. Considering the aforesaid submissions advanced by the petitioners' counsel this Court is inclined to grant the relief of anticipatory bail to the petitioners. Accordingly, let the petitioners named-above, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned in connection with Complaint Case No. 333 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
