The petitioner seeks bail in Bhawanipur (Balia) Police Station (for brevity PS) Case No 103 of 2020 instituted for the offence punishable under Sections 302, 201/34 of Indian Penal Code.
Brother-in-law of the informant has intimated about fleeing away of his wife from the house. On arriving at his sister's matrimonial home, informant has learnt that she has been murdered. The dead body was lying in the maize field and the cause of death has been found to be electrocution. It is submitted by the petitioner's counsel that in the post mortem report, there is no injury found on the body of the
Patna High Court CR. MISC. No.37873 of 2020(3) dt.25-02-2021 2/2 victim. However, the death of the victim has been confirmed. The petitioner has falsely been implicated in this case and he is in custody since 03.06.2020.
Learned APP for the State has opposed the prayer for bail referring to the material collected in course of investigation. It is submitted that the statement of the son of the petitioner has lent credence to the prosecution case and material has come regarding the hostile relation of the petiioner with the deceased (second wife).
Having regard to the submissions advanced by the parties, this Court is not inclined to grant bail to the petitioner. Prayer for bail is rejected.
