JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 25-01-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Madhepura (Ghailarh O.P) P.S. Case No. 839 of 2019 registered for the offence punishable under Sections 366, 504, 506 and 34 of the Indian Penal Code.
The petitioner had earlier approached this Court for grant of regular bail, which was rejected by an order dated 06.03.2020 passed in Cr. Misc. No. 77800 of 2019 with an observation that the petitioner shall be at liberty to renew his prayer for bail after six months, if there was no substantial progress at the trial.
There is clear statement in paragraph 12 of this
Patna High Court CR. MISC. No.2141 of 2021(2) dt.25-01-2021 2/2 application that till filing of the present application even charge has not been framed.
Considering the aforesaid circumstance, this application is allowed.
Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court of Chief Judicial Magistrate, Madhepura in Madhepura (Gailarh O.P) P.S.
