The petitioner, who is in custody, seeks bail in connection with Sahebpur Kamal P.S. Case No. 190 of 2017 registered for the offence punishable under Sections 395 and 328 of the Indian Penal Code.
The allegation against the petitioner is that on 03.07.2017 the informant, who is a truck driver, proceeded from Khagaria for Nutri Craft India Pvt. Ltd. Ram Nagar Baranasi. When reached at N.H-31, a bit forward from Railway Bridge, from behind a black coloured Bolero in which 5-6 persons were boarded stopped the truck, and one person dragged him and started abusing and assaulting him. Patna High Court Cr.Misc. No.44967 of 2017 (2) dt.20-09-2017 persons administered intoxicated medicine on the point of gun and snatched Rs. 25,400/- from the pocket and a golden chakti from the neck.
Learned counsel for the petitioner submits that the petitioner is not named in the FIR and he has not committed any offence and has falsely been implicated in this case by the police only on the basis of confessional statement and nothing had been recovered from his conscious possession. Petitioner has got clean antecedent and he is in custody since 10.07.2017. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Begusarai, in connection with Sahebpur Kamal P.S.
