JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-12-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

This is an application for grant of regular bail for offences punishable under Sections 302/201 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that the petitioner is not named in the First Information Report rather his name transpired in this case only on the basis of suspicion. Petitioner happens to be the father-in-law of the deceased and the co-accused, who is the brother-in-law of the deceased, has already been granted bail by this Court vide order, dated 18.10.2016, passed in Criminal Miscellaneous No. 45175 of 2016. Heard learned A.P.P. also.

Considering the facts and circumstances of the case and

Patna High Court Cr.Misc. No.54775 of 2016 (2) dt.20-12-2016 2/2 on perusal of the impugned order, it appears that the petitioner's name transpired in this case only on the basis of suspicion on account of the fact that petitioner happens to be the father-in-law and allegedly the deceased was in illicit relationship with his saali (Sister-in-law) and also the fact that the co-accused of this case has already been granted bail by this Court and the petitioner is languishing in judicial custody since 13.06.2016, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M -IV, Nalanda, Biharsharif in connection with Rajgir P.S. Case No. 07 of 2016. .
