Petitioner seeks regular bail in a case registered for the offence punishable under Section 328, 307/34 of the Indian Penal Code.

As per the prosecution case, this petitioner mixed poison in the food of informant with an intention to kill him and his family.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. Petitioner is son-in-law of the informant. It is submitted that a dispute was going on between the daughter of informant

No.53117 of 2021(3) dt.21-01-2022 2/2 and this petitioner for which Complaint case No. 164/2021 was lodged by the daughter of informant and, therefore, question of visiting the house of informant does not arise. Petitioner is in custody since 16.03.2021 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kishanganj in connection with Paharkatta PS case No. 21/2021.
