The petitioners are apprehending their arrest in connection with Lalganj P.S.Case No.40/2019 , registered for offences punishable under Sections 323, 341, 324, 307, 379 504 and 506/34 of the Indian Penal Code.

Prosecution story discloses that the petitioners and other accused persons came variously armed and assaulted the informant by lathi and danda causing severe injury to him. Submission of the learned counsel for the petitioners is that prior to this case for the same occurrence, a case had been lodged by the petitioners' side, in which the father of the

Patna High Court CR. MISC. No.42819 of 2019(2) dt.12-07-2019 2/2 petitioners has also received injuries and so far injuries to the informant is concerned, that is simple in nature, which will appear from the impugned order itself.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Vaishali at Hajipur in connection with Lalganj P.S.Case No.40/2019, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid direction, this application is allowed.
