1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Harlakhi Police Station Case No. 66 of 2024, dated 22.03.2024, disclosing offences under Sections 420/467/468/471/120(B) of the Indian Penal Code.
3. The prosecution case, as per the First Information Report, is that the petitioner obtained the appointment as Block Teacher on the basis of fake educational certificate.
4. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case on the basis of confirmation of the certificate as fake by the Bihar Sanskrit Shiksha Board. The petitioner was granted regular bail in the year 2009 for the similar
Patna High Court CR. MISC. No.46496 of 2024(2) dt.07-08-2024 2/2 allegations raised against him earlier.
5. I have heard learned counsel for the parties and have gone through the materials available on records.
6. It appears that earlier the First Information Report was lodged against the petitioner in the year 2007 under Sections 419/420/467/468/471472/120(B)/34 of the Indian Penal Code read with Section 63 of the Copyright Act having allegation that a gang was involved in the business of preparing and supplying forged certificates to persons which was utilized for procuring jobs as teachers in primary and middle schools.
7. In the present case, the allegation is different that the petitioner obtained appointment as Block Teacher on the basis of fake certificate.
8. Having regard to the submissions made on behalf of the parties and taking into consideration the nature of allegation and its gravity, I am not inclined to grant the petitioner privilege of anticipatory bail.
